Panchayati Raj Institutions (PRIs) and Urban Local Bodies (ULBs)

India's democratic framework extends to the grassroots level through Panchayati Raj Institutions (PRIs) in rural areas and Urban Local Bodies (ULBs) in urban areas. This system of local self-governance was given constitutional recognition by the 73rd and 74th Constitutional Amendment Acts of 1992, respectively.

73rd Constitutional Amendment Act, 1992

This Act added a new Part IX to the Constitution, titled "The Panchayats," and a new Eleventh Schedule. It provides for a three-tier system of Panchayats at the village, intermediate, and district levels (though states with a population not exceeding 20 lakhs may not have the intermediate level). Key features include:

Mandatory establishment: Gram Sabha, direct elections to all seats in Panchayats, reservation of seats for SCs/STs (proportionate to their population) and women (not less than one-third).
Duration: A fixed tenure of five years for Panchayats.
Finance Commission: Constitution of a State Finance Commission to review the financial position of Panchayats.
State Election Commission: Constitution of a State Election Commission to conduct elections to Panchayats.

74th Constitutional Amendment Act, 1992

This Act added a new Part IXA to the Constitution, titled "The Municipalities," and a new Twelfth Schedule. It provides for three types of Municipalities: Nagar Panchayats (for transitional areas), Municipal Councils (for smaller urban areas), and Municipal Corporations (for larger urban areas). Its provisions are largely parallel to the 73rd Amendment, including reservations for SCs/STs and women, a five-year tenure, and the establishment of a State Finance Commission and a State Election Commission for Municipalities.

State Election Commission (SEC)

The SEC is a constitutional body established under Article 243K (for Panchayats) and Article 243ZA (for Municipalities) of the Indian Constitution. Its primary responsibility is the superintendence, direction, and control of the preparation of electoral rolls for, and the conduct of, all elections to the Panchayats and the Municipalities. The State Election Commissioner is appointed by the Governor of the state. The conditions of service and tenure of office are determined by the Governor, but the Commissioner cannot be removed from office except in like manner and on the like grounds as a Judge of a High Court. This provision ensures the independence of the SEC, similar to the Election Commission of India (ECI), which conducts elections for Parliament and State Legislatures. However, unlike the ECI, the SEC is a single-member body in most states.
