What is Mediation?

Mediation is a structured, interactive process where an impartial third party, the mediator, assists disputing parties in resolving conflict through the use of specialized communication and negotiation techniques. Unlike a judge or an arbitrator, a mediator does not decide the outcome of the dispute. Instead, the mediator facilitates dialogue, helps parties identify their interests, explore options, and reach a voluntary, mutually acceptable agreement.

Key Principles of Mediation:

Voluntary: Parties participate willingly and can withdraw at any stage.
Confidential: Discussions and information shared during mediation are typically kept confidential.
Party Self-Determination: Parties retain control over the outcome and are responsible for crafting their own solutions.
Impartiality: The mediator remains neutral and does not favor any party.
Non-Adversarial: It focuses on cooperation and finding common ground rather than assigning blame.

Legal Framework in India:

Historically, mediation in India gained prominence through various legal provisions:

Code of Civil Procedure, 1908 (Section 89): Empowered courts to refer disputes to Alternative Dispute Resolution (ADR) mechanisms, including mediation, conciliation, arbitration, and judicial settlement.
Arbitration and Conciliation Act, 1996: While primarily dealing with arbitration, it also provided a framework for conciliation, which shares many similarities with mediation.
Commercial Courts Act, 2015: Mandated pre-institution mediation for commercial disputes, highlighting its importance in business resolution.
The Mediation Act, 2023: This landmark legislation provides a comprehensive framework for mediation in India. It aims to promote and facilitate mediation, particularly institutional mediation, for the resolution of disputes, both domestic and international. Key features include mandatory pre-litigation mediation for certain disputes, enforceability of mediated settlement agreements, and provisions for online mediation. The Act seeks to make India a hub for international mediation.
